Who is responsible for your data

Digital Macro Sphere is a sole proprietorship operated by David Junior Mugo, working remotely from Kenya and serving clients in Kenya and the United States. There is no separate company, so the person responsible for your information — the data controller, in the language of the law — is David Junior Mugo. What we collect, and only when you send it

There is no account to create and nothing is collected from you for simply reading the site. The contact form is the only place this site gathers personal information.

• Your name and email address, which are required in order to reply to you.
• Your company, budget range and what you need help with — all optional, and only if you choose to fill them in.
• The message you write.
• Your IP address, used at the moment you submit to limit how often the form can be sent and to run an automated check that you are not a bot. It is not written into the email and not kept afterwards.

Why we hold it

To read your enquiry and reply to it, and then to carry on that conversation if it turns into a project. That is the whole purpose. Your details are not added to a marketing list, not sold, not shared with anyone beyond the two providers named below, and not used to build any kind of profile. This site runs no analytics and no third-party advertising.

The legal basis is straightforward: you sent the message, and we use it for the thing you sent it for. If you would rather not use the form, emailing directly works just as well.

How long we keep it

Your enquiry is kept until it reaches a definite conclusion — either we begin working together, or one of us decides not to — and is deleted within twelve months of that point. If a project goes ahead, the correspondence becomes part of the project record and is kept for as long as that engagement and its normal business and tax obligations require. You can ask for it to be deleted sooner at any time.

Who else handles it

Two service providers touch your enquiry on the way to the inbox. Both are named here deliberately, so you can look them up.

• Vercel hosts this website and runs the automated bot check on the form. Your submission passes through their infrastructure.
• Resend delivers the enquiry as an email. They process it in order to send it.

Your enquiry is not stored in any database belonging to this site. It exists as an email in an inbox, and briefly in the systems of the two providers above.

Both providers operate outside Kenya, mainly in the United States, so sending your enquiry involves transferring it abroad. This is unavoidable for email to work at all, it happens only because you chose to make contact, and it is limited to what you put in the form.

What this site stores in your browser

One thing: whether you prefer the light or dark theme, saved locally under dms-theme so the site does not flash the wrong colours on your next visit. It never leaves your device and it identifies nobody. There are no advertising or analytics cookies. The bot check may read technical signals from your browser at the moment you submit the form, purely to tell a person from a script.

Your rights

Under Kenya’s Data Protection Act 2019 you can ask to see the personal information held about you, have it corrected if it is wrong, have it deleted, object to how it is being used, or request a copy of it. Email djmugo@digitalmacrosphere.com and it will be actioned — realistically within a few days, and within thirty days at the outside.

If you are not satisfied with how a request is handled, you can complain to the Office of the Data Protection Commissioner in Kenya.

If you are in the United States

Your information is handled exactly the same way, and the rights described above are extended to you as a matter of practice rather than obligation. Digital Macro Sphere is a sole proprietorship whose enquiry volume falls well below the thresholds at which state privacy laws in the USA begin to apply. Ask for your data to be deleted and it will be deleted, wherever you are.

This site is not intended for children, and no part of it is designed to collect information from anyone under 18.

Changes to this notice

If how enquiries are handled changes — a different email provider, a new tool in the pipeline — this page is updated and the date at the top changes with it. There is no version history to dig through; what you see here is what currently happens.
